Homonyms, Illiteracy to Blame for New YouTube Lawsuit
UTube is suing YouTube because Internet users can't spell.
The equipment manufacturing company has filed suit in Ohio federal district court, arguing they've incurred dramatic Web support costs and lost business because surfers looking for YouTube (youtube.com) accidentally visit Universal Tube's site (utube.com) instead. Traffic to Universal Tube's site has apparently increased from 1,500 unique visitors per month to 2 million.
The news comes from KLTV 7 in Ohio (it's so cute how they're Web stories are written like TV copy). Utube wasn't available for comment. The lawsuit isn't available in court records yet, but I'll check again tomorrow.
My gut reaction says Utube has no case, especially since the traffic can be seen as free advertising for their products. Plus Universal Tube would have to prove they lost business they would have gained specifically because of their Web site, and since they don't do sales directly online, that could be a problem.
Besides, I've seen the traffic logs for sites that get 1,500 unique visitors per month. Those visitors are called indexing spiders. They don't buy too many tubes, either.
